Update: Non-Compete's and Jimmy John's

In October 2014, we wrote about Jimmy John's and their controversial non-compete agreements imposed upon their employees.  Well, the New York Attorney General recently found that the non-competes were in fact unlawful and Jimmy John's must cease enforcement of the agreements - in the state of New York.  This outcome makes it likely that the notable "Freaky Fast" empire will either amend their current agreements or cease use altogether in other states. Per the NY Attorney General, use of the agreements for low-wage employees:

"...limit mobility and opportunity for vulnerable workers and bully them into staying with the threat of being sued."

When used tactically, non-compete agreements will protect your business and its intel, but be mindful that it is not being used to stifle your employee's career advancement.
